Labels are only a starting point
“Comparative” and “contributory” negligence labels summarize outcomes, but statutory scope, judicial decisions, claim type, and transition dates matter. Read the actual rule and definitions before drawing a conclusion.
Separate reduction from a recovery bar
Ask whether damages are reduced by a percentage of fault and whether a threshold can bar some or all recovery. Also ask whose fault is counted and whether nonparties may appear on a verdict form.
Preserve evidence relevant to allocation
Photos, video, measurements, witness details, maintenance records, electronic data, and contemporaneous statements may bear on what each person did. Keep original files and note where each item came from.
Avoid making admissions from an incomplete record
Give factual information when required, but distinguish what you personally observed from what you inferred later. A lawyer can advise about communications with insurers and other parties.
