Read the written fee agreement
The agreement should explain how the fee is calculated, whether the percentage changes, which recoveries are covered, and when a fee becomes payable. State rules and the agreement control.
Separate fees from case expenses
Filing, records, experts, depositions, travel, investigation, and other costs may be treated separately from attorney fees. Ask who advances them and who is responsible if there is no recovery.
Ask who will work on the matter
Confirm the responsible lawyer, other lawyers or firms that may participate, how any fee division is handled, and whether staff or outside providers perform particular work.
Understand ending or transferring representation
Ask what happens to fees, expenses, the file, and deadlines if either side ends the relationship or another firm becomes involved. Obtain answers in writing before signing.
